Usual questions regarding Cookies

Why are so many notifications regarding the cookies use?

In 2012 a modification regarding the article number 2.2 of the Spanish Law “Ley 34/2002 de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSICE)” took place. Before this modification, it was implied that websites notified of the use of cookies in texts titled “Legal Notice”, “Using Conditions”, “Terms of use”, “Data Protection Policy”… but this practice wasn’t considered enough for user’s protection.

After the 2012 modification, it was established that every user must consent on the use of cookies, after being informed of the uses to which they are destined.

Which are the fines for not following the cookies policy?

Minor offences are punished in Spain with fines up to 30.000 Euros. Major offences can be punished with a 150.000 Euros fine, although the usual fines imposed to offenders are normally between 500 and 25000 Euros.

Can a user disable cookies from his/her computer?

It is possible, but doing this may cause a different working of the web, in some cases producing malfunction of it. Many browsers can be configured to refuse cookies.

Are cookies dangerous to the user’s computer?

No. A cookie is a text file; it is not a program or plug-in. It can be used as a virus, and cannot access to the user’s hard drive. It is the browser and not a person which keeps the cookie of a website when necessary.

Can cookies fill up the user’s hard drive?

Despite the cookies do not occupy so much space (only a few kilobytes), once the user surfs through internet, accumulation of cookies may occupy a big space in the hard drive. To prevent this from happening, browsers and operative systems have their own mechanisms, usually by allowing saving just a limited number of cookies. When this number is exceeded, the browser automatically eliminates the less used cookies.

Who must follow this regulation?

  • Corporate websites in general.
  • Corporate websites of freelancers, despite if they are used to inform about their businesses or as online shops
  • Online shops and other electronic commerce virtual platforms.
  • Media or particular blogs which include publicity.
  • This is applied to companies and professionals established in Spain as well to foreign websites aimed to Spanish public.
